These Terms & Conditions ("Terms") govern your use of TrainConfirm, a service provided by Alistair Hynes, trading as Admiration Media ("we," "us," "our"), a sole trader based in the United Kingdom. By creating an account or using TrainConfirm, you agree to these Terms.

Admiration Media currently operates as a sole trader. This section will be updated if the business becomes a registered limited company.
TrainConfirm lets businesses upload training videos, send unique one-time links to staff, and receive a digitally signed confirmation when a staff member has watched the video. We generate compliance reports based on this activity.
You must provide accurate information when creating an account, and you're responsible for keeping your login credentials secure. You must be authorised to act on behalf of the organisation you register, and at least 18 years old.
We offer a 14-day free trial with no credit card required. After the trial ends, continued use requires choosing a paid plan, as shown on our pricing page. Plans are billed monthly via Stripe and renew automatically until cancelled.
If a payment fails, we provide a short grace period (currently 3 days) during which your account remains active while you update your payment details. If payment isn't resolved within that period, access to your dashboard will be paused until it is.
You can cancel at any time via the billing portal in your account settings. Cancellation takes effect at the end of your current billing period; we do not provide refunds for partial periods except where required by law.
You agree to use TrainConfirm only for lawful purposes. In particular, you agree not to:

You retain ownership of any videos or content you upload. By uploading content, you grant us a limited licence to host, store, and stream it solely for the purpose of providing the service to you and your staff.
The TrainConfirm name, logo, software, and platform are our property (or licensed to us). Nothing in these Terms transfers any of that intellectual property to you.
Our collection and use of personal data is described in our Privacy Policy. Where we process staff or recipient data on your behalf as a Processor, our Data Processing Agreement applies.
We aim to keep TrainConfirm available and reliable, but the service is provided "as is" and "as available," without a guaranteed uptime commitment at this time. We are not liable for temporary unavailability caused by maintenance, third-party providers, or circumstances outside our reasonable control.
To the maximum extent permitted by law, our total liability to you arising from or in connection with these Terms or your use of TrainConfirm is limited to the total fees you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential losses, including loss of profits, data, or business opportunity.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be excluded or limited.
You agree to indemnify us against claims, losses, or damages arising from your misuse of the service, your breach of these Terms, or your failure to have a lawful basis for data you submit to TrainConfirm.
Either party may terminate the agreement at any time, subject to Section 4 regarding billing. On termination, data is handled as described in our Privacy Policy and Data Processing Agreement.
We may update these Terms as the service evolves. We'll update the "Last updated" date above when changes are made, and will make reasonable efforts to notify active customers of significant changes.
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
